Privacy Shield: joint annual review in September 2017

Scenario
On March 31, the EU Commissioner for Justice, Věra Jourová, announced that the review of the EU-US Privacy Shield will take place in September this year. The announcement was also confirmed in the Article 29 Working Party’s April plenary meeting, which stated that the discussion with the European Commission has already started and the review is scheduled in the Autumn 2017.
Main issues
The joint annual review is the mechanism established by the EU-U.S Privacy Shield which consists of the monitoring of the agreement with regard to U.S. commitments, including the access to data for law enforcement and national security purposes. In this perspective, the joint annual review announced for September 2017 will evaluate the effectiveness and robustness of the guarantees provided by the US on the Privacy Shield.
Practical actions
The joint annual review will be conducted by the European Commission and the U.S. Department of Commerce, involving experts from the U.S. and European Data Protection Authorities. A public report will be issued by the European Commission to the European Parliament and the Council based on the review.
